Terms and conditions
Last updated: 10.09.2026
These terms govern the ordering and use of Unrecon's services. They apply to every order placed from the client area and, together with the description of the plan ordered, form the contract between you and us.
01 · Parties and scope
The provider is James Benone, Unrecon, a sole proprietorship, Rue Hoffmann 8, 1202 Geneva, Switzerland, hereinafter “Unrecon”. The counterparty is the natural or legal person placing the order, hereinafter “the client”.
A client acting for purposes outside their professional activity is a consumer. The articles specific to consumers are marked as such; they do not apply to business clients.
Any of the client's own general terms conflicting with these is binding on Unrecon only if Unrecon has accepted it in writing.
02 · Services
Unrecon provides game server hosting, virtual private servers and web hosting, detailed in the description of each plan at the time of ordering.
The stated characteristics — processor, memory, storage, anti-DDoS filtering — describe the resources allocated. Unrecon may change the underlying infrastructure provided it does not reduce the resources allocated to the client during the current period.
03 · Ordering and capacity
The contract is concluded when Unrecon confirms the order electronically. The client warrants the accuracy of the information provided and keeps it up to date from the client area.
The client must have legal capacity. A minor may order only with the consent of their legal representative, which Unrecon may require in writing before opening the service.
Unrecon may refuse an order, in particular where fraud is suspected, where a previous invoice is unpaid, or where the intended use manifestly conflicts with article 09.
04 · Prices and payment
Displayed prices are final prices, in Swiss francs, inclusive of all taxes. No supplement is added at checkout.
Unrecon is not liable for Swiss VAT, its annual turnover being below the threshold of art. 10(2)(a) of the VAT Act; no Swiss VAT is therefore charged. Where value added tax is due in the client's state of residence, it is included in the displayed price and borne by Unrecon.
A business client who provides a valid EU VAT number receives an invoice without tax, under the reverse charge; the displayed price is unchanged.
Services are payable in advance, by monthly period. Payment is collected by Payrexx AG, a regulated Swiss financial intermediary, by card, TWINT or the Swiss payment methods offered at checkout. Any conversion fees applied by the client's bank remain at the client's expense.
In the event of non-payment, Unrecon sends an electronic reminder and may suspend the service ten days after that reminder, then terminate it thirty days after suspension. Data remains accessible during suspension and is deleted in accordance with article 13.
05 · Term and termination
The contract is concluded for a monthly period, tacitly renewed at each expiry unless terminated.
The client may terminate at any time from the client area, with effect at the end of the current period. Amounts already paid for the current period are not refunded, subject to articles 06 and 07.
Unrecon may terminate on thirty days' notice, or without notice in the cases set out in article 10.
06 · Right of withdrawal — European Union consumers
A consumer client residing in the European Union has fourteen days from the conclusion of the contract to withdraw, without reason or penalty. It is enough to write to customer-service@unrecon.ch before that period expires.
As our services are provided immediately, a client who requests that provision before the end of the period acknowledges losing the right of withdrawal once the service has been fully performed, in accordance with art. 16(a) of Directive 2011/83/EU. A client who withdraws during performance owes the amount corresponding to what was supplied up to their request.
Swiss law provides no general right of withdrawal for distance contracts. This article therefore applies to European Union consumers, and to them alone.
07 · Availability and service level
Unrecon guarantees a monthly availability of 99.0% per service, and targets 99.9%.
Availability is measured in whole minutes, per service, over the calendar month, from Unrecon's monitoring, whose readings are published on the service status page. A service is deemed unavailable when it fails to answer the corresponding probe on two consecutive readings.
The following do not count as unavailability: scheduled maintenance announced at least forty-eight hours in advance and not exceeding four hours per month; interruptions attributable to the client, to their configuration or to their own applications; suspensions imposed under articles 04 or 10; force majeure within the meaning of article 14; and failures of transit networks outside the perimeter of Unrecon and its processors.
Where measured availability falls below 99.0%, the client obtains on request a credit equal to the month's unavailability percentage applied to the monthly amount of the service concerned, capped at that amount. The request is sent to customer-service@unrecon.ch within thirty days of the end of the month concerned; the credit is applied to the next invoice.
This credit is the sole compensation due for a failure to meet the availability level.
08 · Backups
Unrecon performs no backup of the data the client hosts on the infrastructure. It is for the client to put their own backups in place, at a frequency and retention suited to their needs, and to check periodically that they can be restored.
In the event of an incident, Unrecon restores the service, not the data. The primary node has no failover to a second site.
This article is material to the assessment of the price: the client is invited to take it into account before ordering.
09 · Acceptable use
The client is solely responsible for the content they host and for how they use the service. They must not, in particular, host or distribute unlawful content, infringe the rights of third parties, send unsolicited communications, conduct attacks, scans or intrusion attempts from the infrastructure, or circumvent allocated resource limits.
Reselling the service or making it available to third parties is permitted only where the plan expressly provides for it.
The client ensures that their own users comply with these obligations and is answerable for their breaches.
10 · Suspension and termination for breach
Unrecon may immediately suspend, without notice, any service whose use compromises the security, integrity or availability of the infrastructure, or in the event of a manifest breach of article 09. The client is informed without delay and invited to remedy the breach.
If the breach is not corrected within seven days, or if it recurs, Unrecon may terminate the contract with immediate effect, without refund of amounts paid for the current period.
Unrecon acts on abuse reports sent to customer-service@unrecon.ch and on orders from the competent authorities.
11 · Data protection
The processing of the client's data as a counterparty is described in our privacy policy.
Where the client hosts personal data on the infrastructure, they remain its controller and Unrecon acts as processor: the data processing agreement published on this site applies and prevails over these terms in all matters relating to data protection.
12 · Liability
Unrecon is liable for damage caused by its fault. Its total contractual liability, on all grounds and per calendar year, is limited to the amount the client paid it during the twelve months preceding the damaging event.
Unrecon is not liable for the loss of data the client has not backed up in accordance with article 08, for loss of profit, or for indirect damage.
These limitations do not apply in the event of intentional or gross fault, nor in the event of harm to life, physical integrity or health, in accordance with art. 100 CO. They do not reduce the mandatory rights of consumers.
13 · End of contract and fate of the data
At the end of the contract, whatever the cause, the client has thirty days to retrieve their data from the client area. After that period, Unrecon permanently deletes it from its infrastructure.
In the event of termination for a serious breach of article 09, that period may be reduced to seven days, or removed where keeping the data is itself unlawful.
14 · Force majeure
Neither party is liable for non-performance due to an event beyond its reasonable control that it could not avoid, in particular a natural disaster, a prolonged power or network outage at a third-party operator, a decision of an authority or an armed conflict.
A denial-of-service attack whose scale exceeds the announced filtering capacity falls under this article.
15 · Amendments, governing law and jurisdiction
Unrecon may amend these terms and informs the client at least thirty days before they take effect. A client who refuses the amendment may terminate at no cost before that date; failing which, the amendment is deemed accepted.
The contract is governed by Swiss law, excluding the Vienna Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Geneva.
Consumer clients retain the benefit of the places of jurisdiction and the mandatory rules of their state of residence. They may also use the European online dispute resolution platform.
